Welcome to the HottestMomInAmerica.com and HottestMomOnline.com websites (the “Site”). For purposes of this Privacy Policy (this “Privacy Policy”), the terms “we”, “us”, “our” or “Hottest Mom In America” refer to 9 TV Productions, LLC.  “You” refers to you, as a user of this Site.  Explained in this section is our Privacy Policy regarding any information you might supply to us when you visit our Site or that we may collect from you.  This Privacy Policy is designed to assist you in understanding how we collect, use and safeguard this information and to assist you in making informed decisions when using our Site.

This Privacy Policy applies to information collected by or provided to the Site.  This Privacy Policy does not apply to your use of unaffiliated sites to which the Site links or any information provided to those sites or collected by those sites, nor does it apply to any information collected offline by us or provided to us offline.

In addition, please note that this Privacy Policy does not apply to any information you may disclose publicly in any chat rooms, message boards, or similar web pages. You should keep in mind that whenever you publicly disclose information about yourself online – for example, via message boards or chat rooms – that information could be collected and used by people that you do not know.  In addition, certain message boards and similar user forums may display IP addresses (as defined below) along with the message poster’s name and message.  We bear no responsibility for any action or policies of any third parties who collect any information you may disclose on the message boards, chat areas or other user forums, if any, on the Site.

Our online privacy protection policy
We respect the privacy of every individual who visits our Site or responds to our interactive advertisements. This Privacy Policy identifies the information we collect about you and how we will use that information.

Information we collect
We collect two types of information:  personally identifiable information (which is information that can potentially be used to uniquely identify, contact or locate you) and non-personally identifiable information (which is information that cannot be used to identify you). 

We only collect personally identifiable information about you when you voluntarily complete and transmit to us a submittal form with personal information about you.  The personally identifiable information we collect in these voluntary submittals includes your full name, postal address, e-mail address, telephone number, and other such information. 

We collect non-personally identifiable information in two ways.  Certain non-personally identifiable information is collected when you voluntarily submit it to us through the Site, such as gender, age, marital status, household income, use of certain aesthetic techniques to improve your appearance, your opinions about the need for certain aesthetic procedures, and any personal information you elect to include in a testimonial, and other such information.  Other non-personally identifiable information is automatically collected by our web servers, cookies (as further discussed below) and through other such means which do not involve any action on your part (e.g., your IP address, the site you just came from, which pages of our Site that you visit, what site you go to next).

The Site may use tracking technologies, such as “cookies.”  Cookies are small data files that enable us to store small bits of information about your use of the Site.  Cookies are not tied to any personal or personally identifiable information.  We currently use cookies to collect non-personally identifiable information and to enable you to use our Site more efficiently (e.g., cookies enable us to deliver more relevant advertisements and content to you in the form of targeted banners and promotions, to limit the number of times we show you a pop up window).  We may use various types of cookies, including session cookies, which terminate as soon as you close your browser, and persistent cookies, which remain stored on your hard drive for longer periods of time and which may be removed by following the browser’s help instructions. 

How we use and disclose information
The information we collect is used (a) to improve the content of our Site, (b) to provide you information or content you have requested, to contact you or to fulfill prizes in connection with a contest or sweepstakes, to provide you customer service, and to make available products and services you have requested, and (c) for any other purpose that is identified at the time of collection. It may also be used to contact you, via e-mail or regular mail, to provide you with information we believe may be of interest to you, such as current promotions, products and services, specials, and new additions to our Site. 

We may disclose your personally identifiable information to:  (a) Medicis Pharmaceutical Corporation, Medicis Aesthetics and any of their subsidiaries, who may use it for the same purposes that we use it; (b) unless prohibited by applicable law, our affiliates (which are other companies that we control, or that control us or that are controlled by the same entity that controls us), who may use it for the same purposes that we use it;  (c) third parties whose products or services you have ordered; (d) our third party service providers solely for their use in connection with providing services to us (e.g., we may provide your personal information to a third party who provides marketing services to us, but they are not permitted to use it for other purposes); (e) governmental and law enforcement agencies in connection with a court order or subpoena or to cooperate with a law enforcement investigation, or to report activities that we in good faith believe to be unlawful; and (f) other third parties if and as necessary to establish or exercise our legal rights or defend against legal claims.  

We may use a third party ad server to serve ads on our Site. They may place their own “cookie” on your computer to help those ads to run. However, we will not provide them with any of your personally identifiable information. For more information about cookies, please see the section “Cookies” above. 

We may also in the future use a third party surveyor to run optional surveys for our Site.  That surveyor would collect non-personally identifiable information for the sole purpose of providing reports to us about our users’ interests and opinions. Except as otherwise expressly discussed in this Policy, only we collect your information.

Other than as described above, and other than as described below under “Corporate Changes”, we do not sell or transfer the information you send to us, including any personally identifiable information, to others. Information that is not personal, or is not associated with any personally identifiable information, such as questions, answers, comments, ideas and suggestions, shall be deemed to be non-confidential, and we shall be free to disclose and use the same for any purpose, without any obligation to you.

Limited demographic data may also be collected at our Site from a third party advertising server, who provides us with the zip code and area code associated with a visitor’s server, along with pages viewed on our Site. We may receive summary, but not individual, reports from a third party ad server, which will tell us how many ads were presented and clicked upon. 

Security
We have taken reasonable precautions to protect your information, but nevertheless, when disclosing any personal information via the Internet, there is always the risk that your information may be intercepted without our consent and, consequently, can be collected and used by others without your consent.  In addition, third party sites that are accessed through links from our Site have separate privacy policies and security measures, and we are not responsible or liable for the practices, policies or security measures implemented on these third party sites.  YOU HEREBY ACKNOWLEDGE THAT WE ARE NOT RESPONSIBLE FOR ANY INTERCEPTED INFORMATION SENT VIA THE INTERNET, AND YOU HEREBY RELEASE US FROM ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THE USE OF INTERCEPTED INFORMATION IN ANY UNAUTHORIZED MANNER.

We are not responsible for the policies or practices of third parties. Please be aware that our Site may contain links to other sites on the Internet that are owned and operated by third parties. The information practices of those sites linked to our Site are not covered by this Privacy Policy. These other sites may send their own cookies to users, collect data or solicit personal information. Additionally, other companies which place advertising on our Site may collect information about you when you view or click on their advertising through the use of cookies. We cannot control this collection of information. You should contact these advertisers directly if you have any questions about their use of the information that they collect.

If you don't want us to collect any personal information
You may choose not to provide any personal information to us by electing not to voluntarily enter personal information into a form or data field on our Site. You can also limit the use of personal information by checking or unchecking options provided at the time that you enter that information. Finally, you can contact us as provided below and request that we delete any personal information we may have collected. 

Protecting the privacy of children
Our Site is not intended nor directed for the use of children.  Most of the online services that we offer are designed for individuals who are 13 years of age or older.    Children (persons under the age of 13) are not eligible to use the Site, and we ask that children do not submit any personal information to us.  If you are under the age of 13, you may only use this Site in conjunction with and under the supervision of your parents or guardians. 

Also, products and services advertised on the Site may not be suitable for persons of all ages.  For example, the product Restylane® is not suitable nor intended for persons under the age 18.  You should check with the applicable site of any product or service for information regarding that product or service.

Not covered by HIPAA regulations
Although our sponsors may offer products that require a prescription or be administered by a physician, we are not a “covered entity,” like a physician or a hospital under the federal regulations implemented by the Health Insurance Portability and Accountability Act (HIPAA). Therefore, the information you provide is not subject to the specific protections and requirements of those regulations.  

Acceptance; Updates to Privacy Policy
By using the Site, you agree to the terms of this Privacy Policy.  This Privacy Policy may be changed from time to time and any changes will be posted on our Site. We will not notify you individually of any changes we make.     

Corporate Changes
We may sell, transfer or otherwise disclose your information, including personally identifying information, to a successor entity in connection with a corporate merger, consolidation, bankruptcy, the sale of substantially all assets, or other fundamental corporate change in our business.
